During this process, incidents may occur for which the law must provide answers, such as damage inflicted on the towed vehicle. The question which arises is who is responsible for compensating these damages? In this article, we use a library research method to examine this issue. After thorough analysis, it can be concluded that under certain conditions, the traffic police officer who ordered the vehicle tow may bear civil liability for the damages. Under other conditions, the crane operator may be held responsible. This study reviews the civil liability arising from vehicle towing by traffic police across different legal systems, including those of France, the United States, Germany, and Turkey. In all these cases, the government and executive agencies are held civilly liable for these actions, and affected individuals can pursue claims through the relevant legal procedures to obtain compensation. Principles of justice and the protection of citizens' rights in interactions with governmental actions and executive agencies are fundamental in all these legal systems. Individuals can defend their rights and interests through courts and judicial authorities and obtain the necessary compensation. Therefore, this review demonstrates that vehicle towing by traffic police is a significant issue addressed and protected in all legal systems, ensuring the rights and interests of all individuals involved. در سال‌های اخیر آن چیزی که به‌وفور در سطح خیابان‌های شهر دیده می‌شود، حمل خودروهای پارک‌‌شده در محل‌‌های ممنوعه به سمت پارکینگ‌ پلیس راهور توسط جرثقیل‌‌ها است. در این اثنا ممکن است اتفاقاتی رخ دهد که علم حقوق باید پاسخگوی آن باشد؛ ازجمله این موارد، خسارات وارده به خودرویی است که حمل می‌گردد. مسئله این است که مسئولیت جبران این خسارات با کیست؟ ما در این مقاله با روش کتابخانه‌ای به بررسی این مطلب پرداخته و پس از بررسی مطلب می‌توان گفت با حصول شرایطی، مأمور پلیس راهور که دستور حمل خودرو را صادر نموده، در قبال این خسارات مسئولیت مدنی می‌یابد و با شرایطی نیز راننده جرثقیل حمل‌کننده این مسئولیت را به دوش می‌کشد. در این بررسی، مسئولیت مدنی ناشی از حمل خودرو با جرثقیل توسط پلیس راهور در نظام‌های حقوقی مختلف ازجمله فرانسه، آمریکا، آلمان و ترکیه مورد بررسی قرار گرفت. در تمامی این موارد، دولت و نهادهای اجرایی، مسئولیت مدنی این اقدامات را بر عهده دارند و افراد متضرر می‌توانند ادعاهای خود را از طریق رویه‌های قانونی مربوطه مطرح کرده و خسارت موردنیاز را دریافت کنند. اصول عدالت و حفظ حقوق شهروندان در مواجهه با اقدامات دولتی و نهادهای اجرایی در همه این نظام‌ها به‌عنوان اصول اساسی مدنظر قرار گرفته است و افراد می‌توانند از طریق دادگاه‌ها و مراجع قضایی، از حقوق و منافع خود دفاع کرده و خسارت موردنیاز را به دست آورند؛ بنابراین، این بررسی نشان می‌دهد که حمل خودرو با جرثقیل توسط پلیس راهور، یکی از مسائلی است که در تمامی نظام‌های حقوقی مورد توجه و حفاظت بوده و حقوق و منافع تمامی افراد در مواجهه با این اقدامات تضمین می‌شود. /downloadfilepdf/1218386
