Attack against military targets and civilians in time of war, often impact on the environment and also the development of new weapons such as nuclear weapons, has brought serious threats to the environment. Recent cases, sensitivity and concern for the international community to the environmental damage in the event of armed conflict motivated and focused mind to the lawyers. We have also given the importance of this issue, the International Law Commission of the United Nations, the protection of the environment in armed conflict has on its agenda, in the light of the development of customary rules to protect their environment. Because in accordance with paragraph 1 of Article 38 of the Statute of the International Court of Justice, one of the sources of international law, international custom, it should be noted that the environment in addition to the contractual provisions, is also supported by the unwritten rules of customary international law. Therefore, this article seeks to clarify the role and strategies of customary international law in direct support of the environment in time of armed conflict under review. علیرغم اصل عدم توسل به زور و تحریم جنگ در روابط بین المللی، همچنان در شکل مجاز آن مانند توسل به دفاع مشروع، انسان های زیادی کشته و از این رهگذر محیط زیست به شدت آسیب می بیند. حمله در زمان جنگ علیه اهداف نظامی و غیرنظامی، غالباً بر محیط زیست تاثیر گذار بوده و از طرفی گسترش سلاح های جدید مانند سلاح های هسته ای، خطرات جدی را برای محیط زیست به ارمغان آورده است. موارد اخیر، حساسیت و نگرانی جامعه ی بین المللی را نسبت به وقوع صدمات زیست محیطی در زمان وقوع مخاصمات مسلحانه برانگیخته و ذهن حقوق دانان را به خود معطوف داشته است. در حال حاضر نیز با توجه به اهمیت موضوع، کمیسیون حقوق بین الملل سازمان ملل متحد، بحث حمایت از محیط زیست در مخاصمات مسلحانه را در دستور کار خود قرار داده است، تا در پرتو تدوین و توسعه ی قواعد عرفی به حمایت از محیط زیست بپردازد. از آن جا که مطابق بند 1 ماده ی 38 اساسنامه ی دیوان بین المللی دادگستری، یکی از منابع حقوق، عرف بین المللی است، باید توجه داشت که محیط زیست علاوه بر مقررات قراردادی، توسط قواعد نانوشته حقوق بین الملل عرفی مورد حمایت واقع می شود. این مقاله در صدد است تا نقش و راهکارهای حقوق بین الملل عرفی را در حمایت مستقیم از محیط زیست در زمان مخاصمات مسلحانه مورد بررسی قرار دهد. /downloadfilepdf/139605
