Seas have been accorded great importance as routes of maritime transportation in all eras. Thanks to increasing technological advances and huge maritime natural resources, today marine resources have received more attention than ever before, and the need to exploit maritime benefits accounts for the present study. The natural resources of the North Sea of Iran (Caspian) that are shared with regional neighbors and the trawl fishery license granted to china in the southern waters of the country serve as the premises of the present study. Taking into account the official announcement made by authorities regarding their decision to transfer a maritime prowling license (or rent national maritime zones) to china which, according to the reports on the technologies which are to be used for this purpose, could lead to degradation and extinction of living resources, the present study seeks to find out whether the sea prowling licenses are transferable to a third party and whether or not the sovereignty actions within the framework of maritime laws and the act of transferring maritime prowling licenses (with consideration of the need to maintain territorial integrity) to foreigners is legally and jurisprudentially valid. حقوق دریا ها به جهت امتیازات اختصاصی دریا ها از اهمیت ویژه ای برخوردار است. دریاها در تمامی دوران به جهت حمل ونقل دریایی مورد توجه قرار گرفته و اکنون با پیشرفت روزافزون تکنولوژی و وجود منابع طبیعی در آن، بهره برداری از منابع دریایی بیش ازپیش مورد توجه است. همین امر سبب شده تا قابلیت تملک منافع آن نیازمند دقت نظر گردد. منابع دریای شمالی ایران، خزر (کاسپین) و تقسیم آن با همسایگان این خطه و واگذاری مجوز صید ترال به چینی ها در آب های جنوبی کشور زمینه ساز تحقیق حاضر شد. این پژوهش در پی پاسخ به این پرسش مهم است که اساساً در قوانین ایران آیا دریاهای سرزمینی قابلیت واگذاری را دارند یا خیر؟ از یک سو، در جنوب کشور با اعلام رسمی مقامات، سخن از واگذاری مجوز یا به تعبیر عوام، اجاره دریا به صیادان چینی برای طولانی مدت در قرارداد 25 ساله داده شده و از سویی دیگر، با فناوری های اعلامی، تمامی موجودات زنده آن به مرور به تاراج می رود. با توجه به این موارد، حدود اعمال حاکمیتی در چهارچوب قوانین دریایی و امکان واگذاری آن با لحاظ حفظ تمامیت ارضی یا واگذاری منابع موجود در آن به بیگانگان با استناد به منابع فقهی و متون قانونی مستند و پشتوانه قانونی را دارا است یا خیر؟ این پرسش¬ها، اساس پژوهش حاضر را بنیان نهاد. /downloadfilepdf/777399
