In the same way, the legislator has always tried to reduce the legal defects as much as possible by benefiting from the experiences of other countries and enacting various laws in the field of environment. Also, in Iran's legal system, in addition to laws, many regulations and approvals have been implemented to protect the environment from destruction, most of which have criminalized environmentally destructive activities; that is, they have explained environmental crimes. However, the painful fact is that despite all the efforts of the legislature, executive and judiciary, the position of our country at the global level in terms of protecting the ecosystem and environmental positions has not been accepted. In this research, with the analytical-descriptive method and using library resources, the criminal protection of clean air and the challenges in this field have been analyzed and appropriate solutions have been presented. حمایت کیفری از هوای پاک دارای اهمیت فراوانی است. به همین سان، مقنن همواره تلاش داشته تا با بهره مندی از تجارب کشورهای دیگر و وضع قوانین مختلف در زمینه محیط زیست، نقیصه های حقوقی را تا حد ممکن بکاهد. همچنین، در نظام حقوقی ایران علاوه بر قوانین، آیین نامه ها و مصوبات فراوانی جهت محافظت از تخریب محیط زیست اجرا شده است که در اغلب آن ها اقدام به جرم¬انگاری فعالیت های مخرب محیط زیست صورت گرفته است؛ یعنی جرائم زیست محیطی را تبیین کرده است. بااین¬حال، واقعیت دردآور این است که با وجود تمامی تلاش های قوه مقننه، مجریه و قضاییه، جایگاه کشور ما در سطح جهانی از لحاظ حفاظت از زیست بوم و مواضع زیست محیطی مقبول نیفتاده است. در این تحقیق با روش تحلیلی-توصیفی و با بهره گیری از منابع کتابخانه ای، به تحلیل و بررسی حمایت کیفری از هوای پاک و چالش های موجود در این زمینه پرداخته و راهکارهای مناسب ارائه شده است. /downloadfilepdf/883773
