In this article, the tension between religious order and international law with regard to the application of religious sovereignty through the supervisory body of the Guardian Council and by using Weber's theory of religion and rights was shown in order to determine to what extent the political system can resolve this tension with the right of protection. Shariah supervision has been agreed upon. The findings show that there is a serious conflict between the rule of Sharia and modern laws in international law, on the one hand, the issue of the priority of government rulings over Sharia rulings has been a pretext for the expedient application of domestic and international laws, and on the other hand, the number of international treaties that despite being contradictory to the Shari'ah have been approved according to the needs of the day are not few. As a result, the function of Sharia supervision of the Guardian Council as an institution that legitimizes laws cannot be seen as effective, because this institution has caused the politicization of social and cultural rights by interfering with religious considerations on laws instead of benefiting from collective wisdom. دست نیافتن به اهداف و پیامدهای مورد انتظار در توسعه اجتماعی، موضوع قانون‌خواهی و قانون‌گریزی را به یک مسئله پیچیده اجتماعی متأثر از ابعاد حقوقی و تاریخی تبدیل نموده است. در این مقاله، تنش میان امر دینی و حقوق بین‌الملل با توجه به اعمال حاکمیت دینی از مسیر نهاد نظارتی شورای نگهبان و با استفاده از نظریه‌های دین و حقوق وبر تبیین گردید تا مشخص شود که تا چه اندازه نظام سیاسی این تنش را با ابزار حق تحفظ و نظارت شرعی، تبدیل به توافق نموده است. یافته‌ها نشان می‌دهد که تعارضی جدی میان حاکمیت شرع و قوانین مدرن در حقوق بین‌الملل وجود دارد؛ از یک سو، موضوع اولویت حکم حکومتی بر حکم شرعی یک دستاویز برای اعمال مصلحت‌اندیشانه قوانین داخلی و بین‌المللی بوده است و از سوی دیگر، تعداد معاهدات بین‌المللی که با وجود مغایرت‌های شرعی و بنا بر ضروریات روز به تصویب رسیده‌اند، کم نیست. درنتیجه، نمی‌توان کارکرد نظارت شرعی شورای نگهبان را به‌عنوان یک نهاد مشروعیت‌بخش به قوانین، کارآمد دید زیرا این نهاد با دخالت ملاحظات مذهبی بر قوانین، به‌جای بهره بردن از خرد جمعی باعث سیاسی شدن حقوق اجتماعی و فرهنگی شده است. /downloadfilepdf/997808
